WestJet’s Travel Agent Appreciation Month Contest
Official Contest Rules (the “Official Rules”)

The “Travel Agent Appreciation Month Contest” (hereinafter referred to as “Contest”) is a contest which allows participants to enter for a chance to win one of the offered prizes, pursuant to these Official Rules, which are available online at contests.westjet.com. The sponsor of this contest is WestJet, an Alberta Partnership (hereinafter referred to as the “Sponsor”) and can be contacted here: trademarketing@westjet.com, 22 Aerial Place NE, Calgary, Alberta, T2E 3J1. By taking part in this Contest you accept and agree to be bound by these Official Rules and agree that all decisions of the Sponsor (as defined below) are final and binding. The Contest is subject to all applicable federal, provincial and local laws and regulations and is void where prohibited by law. These Official Rules apply only to this Contest and not to any other promotions, contests, or sweepstakes by the Sponsor.

1. ELIGIBILITY:

Contest is open to Canadian residents (excluding residents of Quebec) who:

a) have reached the age of majority in their province or territory of residence at the time of entry; and

b) are employed as a travel agent with a valid IATA or TIDS number with the Sponsor.

Employees, representatives, or agents (and those with whom such persons are domiciled) of the Sponsor and its affiliated companies are not eligible to enter.

2. CONTEST PERIOD:

Entry into the Contest commences at 09:00 a.m. Mountain Time on May 1, 2023, and ends at 23:45 Mountain Time on June 4, 2023, hereinafter referred to as the “Contest Period”.

3. HOW TO ENTER:

NO PURCHASE NECESSARY TO ENTER OR WIN. All entries must be received through the online submission form with no exceptions.

During the Contest Period, there will be five (5) contests with individual prizing. The contest periods are as follows:

• Week 1: May 1, 2023 (9:00 MT) to May 7, 2023 (23:45 MT)
• Week 2: May 8, 2023 (9:00 MT) to May 14, 2023 (23:45 MT)
• Week 3: May 15, 2023 (9:00 MT) to May 21, 2023 (23:45 MT)
• Week 4: May 22, 2023 (9:00 MT) to May 28, 2023 (23:45 MT)
• Week 5: May 29, 2023 (9:00 MT) to June 4, 2023 (23:45 MT)

To enter (the “Entry”) visit https://contests.westjet.com to complete and submit the Contest entry form. Entries must be fully completed with all the required information. Entries must be received by 23:45 Mountain Time on the date that contest week closes to be eligible to win.

To complete the entry, participants must correctly answer all trivia questions for the contest week. Entrants must also click on the “Submit” button on the page. Participants may only enter the trivia portion of the contest one (1) time.

To obtain bonus entries, participants must book a Premium class or Business class ticket for their client(s) as part of a WestJet air-only or WestJet Vacations booking. Participants must complete the bonus entry form with all required information and click on the “Submit” button on the page. Participants will earn one entry per eligible Premium or Business class booking made during the contest period and are permitted unlimited bonus entries. Bonus entries will be applied to the contest week and associated prize during which the Premium or Business booking was made.

4. PRIZES:

There are five total Prize Winners throughout the duration of the contest.

The total value of prizes awarded during the contest period is $11,018.00 CAD.

Each Prize (the “Prize”) available to be won is as follows:

Prizes must be accepted as awarded and are not transferable or convertible to cash. No substitutions. Prize Vouchers cannot be sold. In the event that it has been sold, Prize Vouchers will become void, and any flight and/or hotel bookings made with it will be cancelled immediately without notice or reimbursement. WestJet does not handle the payment, guarantee transactions, or buyer protection or seller certification, nor will WestJet be liable for the loss of funds resulting from a fraudulent transaction. By redeeming Prize Vouchers, all guests travelling agree to release, and waive all claims against, WestJet relating to any and all liability, damage, or compensation entitlement arising under Canada’s Air Passenger Protection Regulations.

Sponsor reserves the right, in their sole and absolute discretion, to substitute the Prize or a component thereof with a prize of equal or greater value, including, without limitation, but at the Sponsor’ sole and absolute discretion, a cash award.

There are five (5) prizes packages, each subject to the terms and conditions set out below:

Prize 1 – Tokyo, Japan prize package

The Tokyo prize package will be awarded as Prize 1. Entry Period: May 1, 2023 to May 7, 2023. Entry Deadline: May 7, 2023, at 23:45 Mountain Time. The total prize includes:

Tokyo Flight Voucher: The flight voucher for Tokyo is valid for a round-trip airfare in the Economy cabin for two (2) people on a regularly scheduled, marketed, and operated WestJet flight from a Canadian airport serviced by WestJet closest to the winner’s residence, to Tokyo Narita, Japan subject to the conditions set out below.

Conditions:  All WestJet Flight Vouchers awarded in this Contest are valid towards return travel until June 4, 2024. Vouchers are not valid for any flights departing after their expiry date. Vouchers will not be extended beyond their expiry date. Absolutely no changes to destinations, names, travel dates etc., will be accepted once travel has been booked. Flights cannot be booked more than 90 (ninety) days prior to departure. Peak travel dates are not available, such as, but not limited to; all Canadian and U.S. Statutory Holidays (including long weekends) and airline blackout periods (such as but not limited to; Easter, Spring Break [vary from province to province] and Christmas breaks) are not available for travel. Other blackout dates may apply. Winner and his/her/their designated guest (if applicable) must travel on the same itinerary in both directions. Vouchers are not valid for redemption WestJet’s charter or codeshare/interline partners.

This voucher must be taken as offered and is not redeemable for cash. This voucher cannot be sold. Seasonal service and schedule will apply; certain travel dates may not be available. 

Travel arrangements must be made through Sponsor’s agent. Winner and his/her/their guest (if applicable) are responsible for ensuring they meet all travel requirements and have all necessary travel documents (e.g., valid passport, visas, proof of vaccination etc.), if applicable. The Releasees are not responsible in the event any flight holder is refused boarding at any time by the airline or airport security. Any unused portion of the prize will be forfeited. The voucher holder is fully responsible for any and all applicable federal, provincial, and municipal taxes.    

Winner and his/her/their guest (if applicable) are responsible for all incidental costs and expenses not explicitly included in the flight voucher, including without limitation, transportation to and from originating airport, medical insurance, COVID testing, travel documentation, airport improvement fees, checked baggage fees, hotel accommodations, taxes, gratuities, telephone calls, in-room charges, attractions, merchandise, souvenirs, pre-seat selection, food and beverages, parking, car rental taxes, fees and surcharges, car insurance.

Sponsor is not responsible for any flight delays, postponements, suspensions, rescheduling or cancellations, for any reason, of any flight(s) and winner and his/her/their guest (if applicable) will not be compensated in the event of such delay, postponements, suspensions, cancellations, etc., or other event described herein. Prize 2 – Canada Wide Prize package

5. WINNER SELECTION AND NOTIFICATION:

Winner Selection

One (1) winner will be randomly selected from eligible entries received, for each Prize. Winners will be selected on approximately June 5, 2023.

Prize Winner Notification

All winners will be contacted by June 12, 2023, 23:45 Mountain time via email to notify and validate active Travel Agent status and provide a winner’s declaration form that includes a mathematical skill-testing question. In order to be awarded the Prize, the potential winner must correctly answer the mathematical skill-testing question without electronic, mechanical or any other kind of assistance. The skill-testing question will be administered at such time and in such manner as the Sponsor determines in its sole discretion. Potential winners must also complete and sign a Declaration and Release Form confirming compliance with the Official Rules, acceptance of the prize as awarded, without substitution, and releasing the Sponsor, WestJet their affiliated and related companies, advertising and promotional agencies, and their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns (collectively, the “Releasees”) from any liability in connection with any Prize or this Contest. Each potential winner will have until June 30, 2023, at 15:00 Mountain Time to email their signed form to WestJet’s Trade Marketing department, to trademarketing@westjet.com.

If a potential winner fails to return a signed form by this deadline or fails to correctly answer the skill-testing question, the potential winner will be disqualified from the draw and an alternate potential winner will be randomly selected. No correspondence will be undertaken except with the selected Eligible Participants whose Eligible Entry was drawn.

6. GENERAL CONDITIONS:

The Sponsor reserves the right in its sole discretion, to disqualify any individual they find to be tampering with the entry process or the operation of the Contest, or to be using automated methods to attempt to receive additional entries into the Contest, or to be acting in violation of these Official Rules or with intent to annoy, abuse, threaten or harass any other person or to be acting in an otherwise disruptive manner. All decisions of the Sponsor are final and binding. The Releasees i) make no warranty, guaranty or representation of any kind concerning the Prizes, ii) except where prohibited by law, disclaim any implied warranty, and iii) are not liable for injury, loss, or damage of any kind resulting from the acceptance or use or misuse of a Prize, secondary, or tertiary prizes, travel related thereto or from, or entrant’s participation in the Contest.  The Contest will run in accordance with these Official Rules, subject to amendment by the Sponsor.

All entries become the property of the Sponsor. In the event of a dispute regarding who submitted an entry, entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. An entrant may be required to provide proof that he/she/they is the authorized account holder of the email address associated with the selected entry.

Sponsor is not responsible for lost, late, stolen, incomplete, altered, or misdirected entries, for failed, partial or garbled computer transmissions, or for technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware, or software, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or entry to be received by the Sponsor whether or not due to the fault of the foregoing or of any other person, or whether due to computer mishaps, technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the Contest. Proof of sending will not be deemed to be proof of receipt. Any attempt to deliberately damage the Contest Site or to undermine the legitimate operation of the Contests is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. The Sponsor is not responsible for injury or damage to online participants’ or any other person’s computer related to or resulting from participation in the Contest, or downloading materials from or use of Contest Site. If, for any reason whatsoever, any part of the Contest is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures or other causes which in the sole opinion of the Sponsor, could corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, the Sponsor reserve the right, at its sole discretion to cancel, terminate, modify or suspend the Contest and to select a winner from eligible entries received prior to the action taken or in some other manner that the Sponsor deems fair and equitable. The Sponsor is not responsible for typographical or other errors in the offer or administration of the Contest, including but not limited to, errors in advertising, the Official Rules, the selection and announcement of winner, or the distribution of the Prize.

The Sponsor will use your personal information for the purposes of conducting the Contest in accordance with Sponsor’s Privacy Policy, located at www.westjet.com, and applicable law. Sponsor may also use or disclose your personal information for those other purposes for which you have provided your consent. By entering the Contest, entrants release and hold harmless the Releasees from any liability in connection with the Contest or, if declared a winner, of the Prize. Before being declared a winner, each winner will be required to sign and return, within a stipulated period of time, a Declaration and Release Form with the Official Rules, as cited in Section 5.

By accepting a prize, winner consents to the use of their name, place of residence, voice, statements, and photographs or other likenesses for publicity, advertising or informational purposes in any medium or format.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Official Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to the Contest entry form, and/or point of sale, print or online advertising; the terms and conditions of these English Official Rules shall prevail, govern and control.

This Contest is governed by the laws of Alberta and the laws of Canada applicable therein and is void where prohibited by law. The Sponsor reserves the right to cancel or modify the Contest or the Official Rules at any time without notice.

7. INTELLECTUAL PROPERTY:

All intellectual property, including, without limitation, all trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned or licensed by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
