It should be obvious that for everyone to thrive, society must be guided by agreed rules. It cannot be the will of the strongest boy or girl in the class which dictates the way. That is the rule of law. Earlier this year, I took up the position of Co-Chair of the Asset Recovery Committee of the International Bar Association (IBA). The IBA was founded in the aftermath of World War II to promote the rule of law and a rules-based society. Like many, I remember where I was in 1989 when I learned the Berlin Wall had come down. I also recall watching the protests in Tiananmen Square. I remember being told that my grandfather—terribly wounded in World War I and who died when I was a baby—believed the Soviet Union could not last. At the time, that seemed impossible. I remember as a boy the sense of uncertainty that came with living under the perceived threat of a nuclear attack. And yet, the world changes. At times it does so quickly. The rule of law is essential to democracy, human rights, and societal progress. Without it, chaos and corruption can all too easily take root. In uncertain times, the very principles that support thriving societies are the ones most under threat. The legal profession must actively defend these principles, educate the public, raise awareness, and hold failing systems accountable. The rule of law is a privilege we maintain only when we make it a priority. I grew up with the belief that nations sharing common values had joined together in order to keep the peace. Central to those common values is the rule of law. Good people understand that it is the backbone of a functioning international community as well as individual nation states. It is fundamental to economic vitality and to protecting freedoms—of speech, movement, and belief. I am proud to play my part in combatting kleptocracy and promoting democracy and a rules-based society. As Co-Chair, I look forward to prioritising the rule of law as a core theme and focus of the Asset Recovery Committee’s 2025–2027 agenda. Together, we can actively defend these principles and create a framework for future specialists. On that note, one of the committee’s aims is to grow its membership. I would like to invite anyone interested to join—not only the Asset Recovery Committee, but also the IBA’s Anti-Corruption Committee and Rule of Law Forum. Free Legal Webinar: When and how landlords can use alternatives to Section 8 evictions. 21 May 2025 | 12:00 PM | Online Landlords & Letting Agents: you're invited to a free legal webinar on 21 May 2025 at 12pm, where we'll discuss the growing challenges landlords face as the Renter’s Right Bill comes into effect. This legislation will significantly impact eviction processes, particularly by abolishing Section 21 of the Housing Act 1988, which previously allowed for “no fault” evictions. In 2024: - 70% of landlords in England had to evict tenants via a Section 21 notice. - 26% of landlords issued a Section 8 notice, primarily due to property care issues (43%) and rent arrears (42%). Evictions currently take 6-9 months, and with the Renter's Right Bill, we predict delays and increased costs. Landlords and letting agencies will face more complex and prolonged eviction processes. What can landlords do instead of relying solely on Section 8? Our clients have successfully used Private Criminal Prosecutions for issues such as: ✔️ False information provided to agencies ✔️ Dishonestly withholding rent ✔️ Criminal damage to the property ✔️ Nuisance behaviour ✔️ False referees These alternatives provide a quicker and more focused response, especially in situations involving dishonest or criminal tenants.
