How many cities allow for cannabis retail?

When do applications open?

Applications opened at a state wide level in Mississippi July 1, 2022 and there is no definitive closing date.

How many licenses are available?

There is no cap on licenses at the state level. Each city will decide how many licenses they will allow for. Sometimes there is no caps on licenses and having the best real estate location means you will have more access to customers. Other times it’s a competitive merit based process and with limited licenses means higher revenue potential for each store.

What's the process to apply?

Applications will be processed in the order in which a completed application is filed, and licenses will be issued on a first come first serve basis. Investigations will be initiated based on the order in which a complete application is filed.

The Department of Revenue (DoR) enforces the Mississippi Medical Cannabis Act in collaboration with Mississippi State Department of Health. The Alcoholic Beverage Control Enforcement Division within the DoR handles licensing and regulating dispensaries. The DoR will have 30 days to process a completed application.

 

Is real estate required?

Real estate will be required to be approved for a retail store in Mississippi.

 

Proof of real estate could include a Deed of Trust, Lease Agreement, or Contingent Agreement. Land Survey by a Mississippi-licensed surveyor proving that the main entrance of the dispensary is not within buffers / setbacks.

How much does it cost to submit an application

Payment of $40,000 is required to apply. Which includes a $15,000 application fee, and a $25,000 license fee.

 

Note: All $40,000 will be refunded if denied due to 1,500’ buffer from another dispensary. If denied due to any other reason, including violation of other distance restrictions, $25,000 application fee will be returned.
