Take a look at CannDev’s opt in map showing which municipalities allow for retail stores in New York

How many cities allow for cannabis retail?

More than 50% of municipalities (1,500+) in New York have opted in to allow for cannabis retail. Take a look at our opt in map to discover which cities you can open a retail store.

The mean population of the cities that opted out was ~9,000 versus ~25,000 for those that actively opted in, and ~29,000 for those opted in by default. So the majority of opt outs came from small, rural towns, while the major population centers in NY are on board with cannabis retail.

When do applications open?

New York opens for general retail applications October 4th, 2023 and will remain open for 60 days. The sooner an application is submitted the better as it appears processing will occur based on receipt of the application, along with applications that have real estate secured.

How many licenses are available?

There are unlimited licenses available at the state level, and each municipality will dictate if they will have caps on licenses or not. This will in turn affect the viability of a store given how much population each store can serve. Which is why our opt in map is important to get an idea of the landscape of opportunity.

What's the process to apply?

Applications are to be submitted on the New York Business Express web portal. The NY OCM will begin processing retail dispensary applications 30 days after the start of the application period (Oct 4th, 2023) and will continue to accept new applications for the entire 60 day window simultaneously as they are reviewing them.

Will real estate be required?

Yes. In order to submit a retail application in New York a retailer must secure compliant real estate. Due to this risk of being buffered out of your desired location, CannDev strongly recommend securing real estate as soon as possible. In larger jurisdictions with a population of more than 10,000 residents, dispensaries must be at least 1,000 feet from each other, and this distance is further increased to 2,000 feet.
